How can an environmental ius commune foster climate justice in Latin America and the Caribbean?

The project Environment and Climate Change is part of the Ius Constitutionale Commune in Latin America (ICCAL) agenda promoted by the Max Planck Institute for Comparative Public Law and International Law (MPIL) in Heidelberg. Its purpose is to contribute to the development of an environmental ius commune in Latin America and the Caribbean, linking the principles of transformative constitutionalism with the challenges of the climate crisis.

The project examines the interaction between international law, including instruments such as the Escazú Agreement, the Inter-American Human Rights System and national constitutional developments. It aims to identify normative convergences and good judicial practices in the protection of the environment, public participation and the rights of environmental human rights defenders. It also seeks to connect scientific evidence and public policies with the work of courts, international organizations, lawyers and affected communities.

Through an interdisciplinary approach the project connects strategic litigation, comparative research and public policy design, generating open and collaborative knowledge. In dialogue with regional initiatives and the standards of the Inter-American System, it demonstrates how an environmental ius commune can strengthen climate justice and promote sustainable development with social equity in the region.
